# X-046 · Enclosure works on excludability, not rivalry

**The step X-045 names as missing has an answer available from this notebook's own suppression work.** The question: can an increase in operative capacity be privately appropriated without preventing that capacity from remaining socially reproducible?

Classical enclosure operates on **rivalry**. Grazing land is depletable; my sheep eat grass yours cannot. Semantic capacity is not like this. A distinction I use is not thereby unavailable to you; ΔO_s is non-rival in principle, and the entire commons tradition treats non-rivalry as the reason knowledge resists enclosure.

But this notebook has established, repeatedly and measurably, that **operative existence ≈ f(retrievability)** — a distinction that cannot be retrieved has a reduced mode of existence in the field where it would otherwise act. Put those together and the mechanism appears:

That is a defect in a deposited paper (#1549 §7), and it should be carried as a v1.1 amendment rather than absorbed silently — the falsifier as written is weaker than the instrument it depends on.
